ALERT: San Jose City Council To Vote on Gun Tax and Liability Insurance Mandate
The Mayor of San Jose is making good on his promise to put the financial squeeze on local gun owners next week when the City Council formally votes on two anti-2nd Amendment ordinances. Taking a page from Governor Gavin Newsom’s book on government overeach, Mayor Sam Liccardo is attempting to singlehandedly circumvent the Constitution by mandating every gun owner in the city purchase liability insurance and pay a yet-to-be-determined fee to fund so-called “violence reduction initiatives.”
Liccardo first introduced the “Gun Harm Reduction Ordinance” in June of 2021, which is scheduled for a vote on Tuesday 25, 2022. Gun Owners of California encourages citizens in the South Bay area to contact City representatives to express their strong opposition.
Sam Paredes, Gun Owners of California’s Executive Director said “There is zero logic to these proposals. The Mayor has admitted that criminals will ignore the law – but he believes he’s going to curb gun crime somehow by making the good guys buy liability insurance? This is some oddball reasoning for sure.”
GOC has been working with the Golden State 2nd Amendment Council in strong opposition to these measures for the following reasons:
- They are overwhelmingly unconstitutional and mandate that lawful gun owners bear the financial responsibility for the misdeeds of criminals.
- The ordinance is a violation of existing court rulings against Jim Crow laws that tax constitutional rights.
- Insurance companies do not issue policies for firearm liability which means gun owners would not be able to comply with the law.
- The proposal implements taxes at the local level, in violation of the California Constitution on special taxes, Article XIII C Section 2(d)
- If passed, legal action will be taken against the City, and San Jose residents will bear the fiscal brunt of a protracted legal battle.
